England Moves To Legally Enforce School Phone Restrictions

The UK government has moved to legally enforce phone-free policies in schools across England, turning existing guidance into binding law under its Children’s Wellbeing and Schools Bill.

Government moves to tighten school phone rules

However, the UK government said it will introduce a legal requirement restricting smartphone use in schools in England. It plans to embed current guidance into law through an amendment to the Children’s Wellbeing and Schools Bill.

Meanwhile, Education Minister Jacqui Smith told the House of Lords that the government will table an amendment. She said it will create a “clear legal requirement” for schools to follow stricter mobile phone policies.

Furthermore, the Department for Education said the change will give legal backing to practices already in place. Many schools in England already restrict phone use during the school day.

Schools expected to adopt stricter compliance

In response, Education Secretary Bridget Phillipson had earlier written to schools. She urged them to adopt fully phone-free policies throughout the school day.

However, the government now plans to place that guidance on a statutory footing. This will require schools to actively consider and apply the rules.

Furthermore, ministers said their approach differs from opposition proposals. The Conservative Party had pushed for a total legal ban.

Meanwhile, Conservative shadow education secretary Laura Trott welcomed the move. She said it will improve behaviour and academic outcomes for pupils.

Enforcement methods and school concerns

In response, Jacqui Smith told the Lords that some softer approaches like “not seen, not heard” policies will no longer appear in guidance. Schools previously allowed phones switched off and kept in bags.

Consequently, she said the government remains open to stronger restrictions. Schools already use different methods, including lockers and magnetically sealed pouches.

However, full details of the amendment remain unpublished. Officials said Ofsted will monitor compliance from April as part of school safeguarding inspections.

Furthermore, the legislation faced delays between the House of Commons and House of Lords. This followed a Conservative-backed amendment calling for a stricter ban.

Funding and regional policy differences

In response, the Liberal Democrats said the government must provide funding support. Education spokesperson Caroline Voaden said schools need resources to manage the transition.

Meanwhile, she said the policy marks an important shift. However, she warned that implementation will require proper funding.

Furthermore, Association of School and College Leaders general secretary Pepe Di’Iasio said most schools already enforce restrictions. He called for government support for secure storage such as lockers or locked pouches.

He also urged stronger regulation of social media platforms. He argued that much of the harm linked to smartphones happens outside school hours.

UK-wide approaches vary

Meanwhile, approaches to mobile phone use differ across the UK. Education policy remains devolved across regions.

However, Scotland introduced guidance in 2024 allowing headteachers to enforce bans. Wales already allows schools to restrict devices independently.

Furthermore, Northern Ireland recently completed a pilot scheme on phone-free schools. Officials expect findings later this year.
